Ausgangssituation
Die mongolische Justiz befindet sich in einer andauernden Reformierung. Ihre Arbeitsbelastung hat sich in den letzten zehn Jahren mehr als verdoppelt und führt zu unnötig langen Verfahren. Dies trifft neben der Bevölkerung auch Unternehmen. Besonders ausländische Investor*innen schrecken aufgrund des unsicheren Investitionsschutzes davor zurück, in der Mongolei zu investieren und damit Jobs zu schaffen sowie Armut zu mindern.
Bedeutsam für Investitionen ist der Rechtsrahmen für einen klimafreundlichen, sozial gerechten Wirtschaftswandel. Die mongolische Regierung möchte vor allem rechtliche Grundlagen für Energieeffizienz und erneuerbare Energien schaffen. Davon können auch die Bevölkerung sowie der Umwelt- und Klimaschutz profitieren.

Ziel
Unternehmen und die Bevölkerung in der Mongolei haben einen besseren Zugang zu Recht. Die mongolische Justiz ist leistungsfähiger und der Rechtsrahmen für die Just Transition ist ausgebaut.

Vorgehensweise
Das Projekt berät die mongolische Energieregulierungsbehörde fachlich dazu, das Energie-Effizienz-Gesetz umzusetzen. Damit will es die rechtlichen Bedingungen, vor allem für die Just Transition, verbessern und ein positives Investitionsklima schaffen.
Das Projekt fördert die fachlichen Fähigkeiten der Justiz, indem es Schulungen anbietet und politisch berät. Dabei unterstützt es auch Kompetenzen, um eine zentrale Digitalisierungsstelle aufzubauen und zu betreiben. So kann die Justiz den Bürger*innen und Unternehmen nutzerfreundliche und funktionale Zugänge zu Recht ermöglichen.
Das Projekt berät zudem das mongolische Ministerium für Justiz und Inneres (MJI) dazu, relevante Themen zur regionalen Zusammenarbeit zwischen der Mongolei, China, Japan und Südkorea zu identifizieren. Vertreter*innen der Justiz können sich dadurch international austauschen. Gleichzeitig unterstützt das Projekt den Obersten Gerichtsrat dabei, Schulungen für Richter*innnen und Ausbilder*innen umzusetzen und so einen besseren Rechtszugang zu schaffen.

Context
The Mongolian judiciary is in a process of ongoing reform. Its workload has more than doubled in the last ten years, leading to unnecessarily lengthy proceedings. This affects the public and businesses alike. Given uncertain investment protection, foreign investors in particular are reluctant to invest in Mongolia and thus create jobs and reduce poverty.
The legal framework for the just transition, a climate-friendly, socially just transformation of the economy, is also important for investors. The Mongolian Government would therefore particularly like to create and improve the legal basis for energy efficiency and renewable energy. This will also have benefits for the population and for environmental and climate protection.

Objective
Businesses and the public in Mongolia have better access to legal services. The Mongolian judiciary is more efficient and the legal framework for the just transition has been expanded.

Approach
The project provides expert advice to the Mongolian energy regulatory authority on implementing the Energy Efficiency Act. The aim is to improve the legal environment, especially for the just transition, and create a positive investment climate.
The project promotes the specialist skills of the judiciary by providing training and political advice. It also helps build the expertise needed to establish and operate a central digitalisation centre. In this way, the judiciary can provide citizens and companies with user-friendly and effective access to legal redress.
The project also advises the Mongolian Ministry of Justice and Home Affairs (MJI) on identifying relevant topics for regional cooperation between Mongolia, China, Japan and South Korea. This cooperation allows representatives of the judiciary to share ideas internationally. At the same time, the project supports the Supreme Judicial Council in implementing training for judges and trainers in order to improve access to legal services.
