Context

For several years now, the Vietnamese Government has been promoting reforms to the legal system to improve the rule of law. The focus is primarily on reforming economic and social factors. The Office of the Government (OOG) and its Department of Law play a decisive role in this context.

The Department of Law develops new legislation and liaises between the National Assembly, the ministries and other actors who are affected by the proposals. It also advises the Prime Minister and the Government by preparing statements on the planned draft legislation.

Clarifying the legal framework for the environment and the economy is paramount for the socio-ecological transformation of the economy that climate change requires.

Objective

Viet Nam’s legislative process takes into account international legal standards, experience, knowledge and strategies, particularly with regard to a just transition, economic growth and climate change.

Approach

The project supports reforms to Viet Nam’s legal system and provides advisory services, primarily to the Department of Law at Viet Nam’s Office of the Government. In this context, it organises training measures, field trips, international and national workshops and study trips.

The project develops experts’ capacities on specific legal issues. It focuses on a just transition and draws on international experience, findings and strategies with regard to the economy and climate. The project can thus link up with successful international innovations and approaches.

The project improves the partners’ understanding of the rule of law, constitutional law, economic law and international legal standards, which has a positive impact on legislative processes.
